1. Introduction

Welcome to CopaStats, a football statistics mobile application operated by Danetek Limited (‘CopaStats’, ‘we’, ‘us’, or ‘our’). By accessing or using CopaStats (the ‘App’), you agree to comply with and be bound by these Terms of Use (‘Terms’). Please read them carefully. If you do not agree to these Terms, please do not use the App.

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. The Privacy Policy is available at https://copastats.com/privacy and is incorporated herein by reference. By using the App, you acknowledge that you have read and agree to the Privacy Policy.

3. Eligibility

You must be at least 16 years old and meet the minimum age requirement of your local jurisdiction to use the App. By registering an account or using subscription features, you confirm you meet this eligibility requirement and have the legal capacity to enter into this agreement.

4. Account Registration and Security

To use subscription services, you must create an account with accurate and complete information. You are responsible for safeguarding your account credentials and for all activities under your account. Notify us immediately of any unauthorised use. CopaStats shall not be liable for losses caused by your failure to protect your login details.

5. Intellectual Property Rights

All content, data, designs, and trademarks within the App are owned or licensed by CopaStats. You may not replicate, distribute, or commercialise any content without our prior written consent. Unauthorised use may lead to termination of your account and legal action.

6. Use of Data, Logos, and Intellectual Property

The football statistics, team logos, competition logos, and other related content (‘Data and Assets’) displayed within the App are sourced from licensed third-party providers. CopaStats uses these Data and Assets under specified permissions and licenses granted by such providers.

Nothing in these Terms excludes or limits our liability for breach of our obligations under applicable data protection laws, including the UK Data Protection Act 2018 and the EU GDPR, where such exclusion or limitation would be unlawful.

7. Data Accuracy

While we strive to provide accurate and current football statistics and information within the App, CopaStats does not guarantee the completeness, accuracy, reliability, or timeliness of the data. All content is provided ‘as is’ for informational purposes only. You acknowledge that reliance on such data is at your own risk.

8. User Content

If you submit any content or comments, you retain ownership but grant CopaStats a non-exclusive, royalty-free licence to use, display, and distribute such content within the App. Content must not infringe third-party rights or violate laws.

10. User Feedback

Any feedback, suggestions, or ideas you provide to CopaStats through the App or otherwise shall be considered non-confidential and non-proprietary. By submitting feedback, you grant CopaStats a perpetual, worldwide, royalty-free license to use and incorporate such feedback without obligation.

11. Indemnification

You agree to indemnify, defend, and hold harmless CopaStats, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees and expenses) arising out of or related to your breach of these Terms, unlawful use of the App, or infringement of any third-party rights, to the extent permitted by law.

12. Third-Party Content and Services

The App may contain links to or integrate with third-party websites, data providers, or services. CopaStats does not endorse and is not responsible for the content, privacy policies, or practices of any third parties. Use of such third-party content is at your own risk.

13. Data Privacy

Your personal data will be processed in accordance with our separate Privacy Policy, compliant with the UK Data Protection Act 2018 and EU GDPR as applicable. Consent is obtained for data use, including push notifications.

14. Subscriptions and Billing

CopaStats offers optional auto-renewable subscriptions to unlock premium features, including in-depth player stats (shots, fouls, tackles), advanced team stats, and live in-play dashboards. Subscriptions are managed through Apple billing.

Subscription Plans

Taxes and Pricing

Prices are displayed in GBP for UK users and converted to local currencies for other regions. All applicable taxes (including VAT where required) are collected and remitted by Apple Inc. as the merchant of record.

Free Trial

We offer a seven-day free trial for monthly and yearly subscription tiers. The trial requires a valid payment method. If not cancelled before the trial ends, the subscription will automatically renew and the payment method charged.

Cancellation and Refunds

You can cancel subscriptions anytime via the Apple App Store. No refunds are provided for partially used subscription periods. Terms align with Apple’s store policies.

15. Right to Cancel (Cooling-Off Period)

You have the right to cancel your subscription within 14 days of purchase without giving any reason. However, if you wish to access subscription features immediately, you must expressly consent to waive this 14-day cooling-off period and acknowledge that you will lose your right to cancel once you begin using the service.

Where required by law, a statutory cooling-off period may also apply to subscription renewals or significant changes to your subscription. If eligible, you will be notified of this right at the time of renewal or change.

16. Discount Codes, Referrals, and Free Trials

From time to time, CopaStats may offer promotional discount codes or referral programs. These offers are subject to specific terms and conditions, including eligibility, validity period, and usage limits. Discount codes and referral benefits are non-transferable, may not be combined with other offers, and cannot be redeemed for cash. We reserve the right to modify or cancel any promotion at any time without prior notice.

Our seven-day free trial is intended for new users to evaluate CopaStats. Abuse of free trials, including but not limited to creating multiple accounts, using false information, or repeatedly subscribing after trial expiration to avoid payment, is strictly prohibited. We reserve the right to suspend, terminate, or refuse service to users suspected of abusing free trials or promotional offers. Creation of multiple accounts, including those using temporary or disposable email addresses, to abuse free trials is strictly prohibited and may result in permanent bans.

17. Changes to Subscription Pricing and Terms

We may update subscription pricing or other related terms upon reasonable notice. When a price increase occurs, we will notify you at least 30 days in advance via email or in-app notification before the new prices take effect. You have the option to cancel your subscription before the price change without penalty. Continued use of the subscription after the effective date of the price change constitutes your acceptance of the updated pricing and terms.

18. Service Level and Uptime

While we strive to maintain the availability and reliability of the CopaStats App, we do not guarantee uninterrupted or error-free service. Downtime may occur due to maintenance, technological issues, or force majeure events beyond our control.

CopaStats shall not be liable for failure or delay in performance due to force majeure events including but not limited to: acts of God, natural disasters, war, terrorism, civil unrest, labour disputes, government restrictions, failure of third-party services, cyber-attacks, or public health emergencies.

19. App Store Compliance

Use of this App is subject to Apple’s App Store terms and guidelines, including Apple’s End User License Agreement.

20. Push Notifications and Mobile Data

By enabling notifications, you agree to receive alerts related to scores, news, and promotional content. Mobile data usage may apply per your carrier’s charges. You may manage notification permissions in your device settings.

21. Termination and Suspension

We reserve the right to suspend or terminate access for breach of these Terms or unlawful behaviour without notice. Termination may result in deletion of user data in accordance with our data retention policies. Termination does not affect accrued rights or obligations.

22. Disclaimers and Liability

CopaStats is provided ‘as is’ for informational purposes. Though we strive for accuracy, we do not guarantee data completeness or timeliness. Liability is limited to the extent permitted by law.

CopaStats is not responsible for data inaccuracies, delays, or service interruptions caused by third-party providers.

23. Governing Law and Dispute Resolution

These Terms are governed by English law. Disputes will be subject to the exclusive jurisdiction of courts in England and Wales. If you are a consumer and have a complaint, you may be able to use the EU Online Dispute Resolution platform for resolving disputes. 24. Changes to Terms

We may modify these Terms at any time. Users will be notified at least 30 days in advance via email or in-app notification before any changes, including pricing updates, take effect. Continued use after the effective date of such changes constitutes acceptance of the updated Terms.

25. Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable by a court of law, the remaining provisions shall remain in full force and effect. Failure by CopaStats to enforce any right or provision of these Terms will not be considered a waiver of those rights.

26. Apple-Specific Terms

This agreement is between you and Danetek Limited only, not Apple Inc. Danetek Limited, not Apple, is solely responsible for CopaStats and its content. Apple has no obligation to furnish maintenance and support services. In the event of any failure to conform to applicable warranty, you may notify Apple for a refund of the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App or your use of it, including product liability claims, consumer protection claims, or intellectual property infringement claims. Apple and Apple’s subsidiaries are third-party beneficiaries of this agreement, and upon your acceptance Apple will have the right to enforce this agreement against you.

By creating an account, accessing subscription features, or continuing to use the App, you confirm that you have read, understood, and agree to be bound by these Terms of Use.
